Mississippi Drug Laws

 

Mississippi State Statutes:

Mississippi Code Ann. 41-29-141, et seq. (1972 and Supp. 1989), provides that anyperson who knowingly distributes or depenses a controlled substance including, but not limited to, marijuana, or maintains any shop, warehouse, dwelling, vehicle, boat aircraft or other structure and dispenses or sells controlled substances from such place, vehicle or structure, shall be guilty of a crime. The penalties for violation of the statutevary according to whether the act is a first or subsequent offense. The penalties range from conviction and imprisonment of not more then 3 years or fined not more than $3,000.00, or both, to imprisonment of not more than 30 years and fined not less than $1,000.00 , nor more than $1,000,000.00, or both.

It is equally unlawful for a person who is not authorized by the State Board of Medical Licenser, State Board of Pharmacy or other lawful authority to use, or possess with intent to use, paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, ingest, inhale or otherwise introduce into the human body a controlled substance in violation of the Uniform Controlled Substance Law. A schedule of controlled substances is controlled in the Uniform Controlled Substance Law beginning at Miss. Code Ann. 41-29-101 (1972 and Supp. 1989), and includes opiates, as well as opium derivatives such as heroine. Likewise, any material, compound, mixture or preparation which contains any quantity of hallucinogenic substances, their salts, isomers, and salts of isomers is prohibited and includes such drugs as marijuana, mescaline, opiate, amphetamines. Additionally, and specifically at Miss Code Ann. 41-29-115 (Supp. 1989), cocaine, coca leaves and any salt, compound, derivative or preparation of cocaine or coca leaves is specifically prohibited.
